
All BSI property owners should be aware that the efforts of BSIA to defend our deed restrictions and have them reinstated has NOT been resolved and continues. There are two lawsuits:
BSIA vs Munson – original case and appeal
In April of 2025, a hearing was held before a judge challenging the validity of the BSI deed restrictions. This stemmed from the resident refusing to comply with the restrictions. The judge ruled that our deed restrictions had expired in January of 2001.
In June of 2025, we requested a rehearing as the judge ruled using a previous case we believe is faulty. The judge denied the request for a rehearing. This left us with an option to file an appeal, but we had to do so within 30 days. The Board held an emergency meeting and discussed our options. It was agreed that an appeal was our best option, but we would need additional funding.
On July 24, 2025, we filed an appeal with the sixth district court.
On August 11, 14, and 19, 2025, the BSIA President, Past President, and Legal Liaison held meetings by Zoom for BSIA members and non-members. These were interactive information sessions where residents could ask questions. Recordings of those meetings are available below.
The appeal process is expected to take about a year.

The BSIA Board held a Q&A session on legal matters regarding the case with attorney Edward Wotitzky of The Wotitzky Law Firm on October 31, 2025.
