IMPORTANT NOTICE TO BSI PROPERTY OWNERS
This is to inform you that the BSIA Board of Directors intends
to vitalize and enforce the deed restrictions governing all
properties in BSI. As you know, following Hurricane Charley
the Board adopted a more lenient enforcement approach. However,
after nearly two years and a strong confirmation from numerous
property owners, we now believe a more proactive approach
is warranted. Paragraphs 3, 4, 8,9,11, 12 and 20 of the PGI
Section 15 Burnt Store Isles Deed Restrictions require that
any change in the appearance of a property, including new
construction, exterior color, roofing, additions to or subtractions
from existing buildings, landscape design, fencing, seawalls
and overall land usage must be submitted to the BSIA Board
of Directors for approval. A permit from the city of Punta
Gorda does not supplant or supersede BSI deed restrictions
or the approval of the Board. "Properties not maintained
in like-new condition as referenced in the deed restrictions
may require repair and maintenance. This requirement also
applies to the proper maintenance of mowing of vacant lots.
The Association has a right to enforce the deed restrictions
by bringing an action to abate the deficiency or deficiencies." This
assures that the property value of every owner is protected.
Below is a link to an application to request Board approval
of a change in exterior appearance and/or land use. Site plans,
color chips and other information to inform the Board of the
proposed change should be attached to the application and submitted
at least 45 days in advance of the proposed change. The Board
will make every effort to respond within 14 days but not later
than 30 days after receiving the application.
Please retain this notice and application form for future
use. If you have any questions or need additional information,
please contact the BSIA Director of Community Standards at
the BSIA website www.bsia.net where you will also find a current
copy of the BSI deed restrictions. Those without internet access
are invited to contact Terry Miller direct at (941) 505-5035,
With your continued support we will maintain BSI as the premiere
golf and waterfront community in Southwest Florida.
